Quick explanation

You can return a broken television under a complaint (reklamieren).

Why is this correct?

When you buy something, you have a legal right to goods free of defects (statutory warranty).

Background

If a new product is broken, the seller must repair it or replace it with a new one. This is called subsequent performance. The statutory warranty lasts two years from purchase. In the first year it is presumed that the defect already existed at the time of purchase. If the repair does not work, you can reduce the purchase price or withdraw from the contract and get your money back. It is best to go to the shop with the receipt. For online purchases you also have a 14-day right of withdrawal.

Why are the other answers wrong?

Reporting it to the police is not necessary – it is not a crime. Simply swapping the device in the shop without asking is not allowed. A guarantee is a voluntary promise by the manufacturer; extending it does not repair the TV.

Memory tip

Bought broken → complain (two-year statutory warranty).
